Welcome to Hobbyshop website Terms and Conditions of use. These Terms and Conditions apply to the use of this website at www.hobbyshop.cz. By accessing this website and/or placing an order, you agree to be bound by these Terms and Conditions.

1. INTRODUCTION

1.1 You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.

1.2 We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

2. ORDERING FROM US

2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

2.2 Our acceptance of an order takes place when we despatch the order. When we despatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

2.3 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.

2.4 Liquid items can vaporize or spill during transport. These items are send at your own risk.

3. PRICING

3.1 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.

3.2 Our prices are reviewed periodically. 

3.3 Default currency is CZK. All orders are charged in CZK prices, value in different currency depend on actual currency rate.

4. CANCELLATION AND RETURNS POLICY

4.1 If you wish to cancel your order:
(a) you can notify us by email to hobbyshop@hobbyshop.cz before we have dispatched the goods to you; or
(b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.

4.2 You can return goods you have ordered from us for any reason at any time within 14 days of receipt for a full refund or exchange. The costs of returning goods to us shall be borne by you.

4.3 Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required. Refund is done in CZK, refunded amount in other currency depend on actual currency rate.

4.4 The rights to return the goods to us as referred to in clause 4.3 will not apply in the following circumstances:

- in the event that the product has been used

5. SHIPPING AND PAYMENT

5.1 Packages are generally dispatched within 2 working days after receipt of payment and are shipped via Czech Post. Tracking and drop-off with signature depend on selected shipping option. We will provide you with a link to track your package online if applicable.

International orders are shipped using Czech Post. For postal orders, the packages are handed off to your countries postal service for 'door-to-door' delivery. There are five options for postal shipment.

• Czech Post small packet - Airmail with tracking service comes with tracking but isn't insured. It is more expensive. We've rarely had an package lost (although sometimes it will be returned if the destination address is wrong), and it is recommended for small packages. Size and weight of parcel is limited but around 90% of orders meet the criteria for small packet.
  
  
• Czech Post airmail parcel - Standard parcel, delivered by airmail. Weight, size and price limit depend on destination country. Delivery time is around 1-2 weeks
  
  
• Czech Post surface mail - Standard parcel, delivered by surface. Weight, size and price limit depend on destination country. Delivery time is around 1-3 months.

5.2 We will endeavour to deliver all the products you order. In the unlikely event of any product being out of stock at the time we will notify you of this and hold your order until the missing item(s) is/are available. We will not deliver any part of your order until all the items you have ordered are in stock and available for delivery to you. This may affect the normal delivery schedule.

5.3 Shipping fees include handling and packing fees as well as postage costs. Handling fees are fixed, whereas transport fees vary according to total weight of the shipment. We advise you to group your items in one order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them. Your package will be dispatched at your own risk, but special care is taken to protect fragile objects.
Boxes are amply sized and your items are well-protected.

5.4. You understand and agree that Hobbyshop.cz shall not be liable for any direct or indirect damages done by any of the services we provide. All items are purchased at your own risk. Any damage caused by transport is to be taken up by you with carrier. Hobbyshop.cz will provide you with the tracking number if applicable. Once this information is provided to you, it is your responsibility as the customer to contact and deal with the carrier. We do not assume any responsibility for lost packages.

5.5 If you have receive open, damaged or wet parcel don't accept it. Claim it in carrier or return it back to us. Accepted parcels can't be claimed or refunded.

5.6 If parcel is, at your request, sent with low declared value, we can't insure it to full value. These parcels are sent at your own risk and no refund or claim for damaged or uncomplete parcels is allowed .

5.7. When ordering goods from Hobbyshop.cz for international deliveries you may be subject to import duties and/or taxes that apply to your country, Hobbyshop.cz is not responsible for any charges that are incurred from customs/duties whatsoever. Any additional charges for customs clearance are considered outside of our control and Hobbyshop.cz cannot predict the value of what these charges may be. For further information on custom and excise policies in your country, please contact your local customs office.

5.9. We accept types of payment:

• PayPal - Secure and fast type of payment. You can pay by your PayPal account or by payment card (this option depend on country)

6. LICENCE

6.1 You are permitted to print and download extracts from this Website for your own use on the following basis:
(a) no documents or related graphics on this Website are modified in any way;
(b) no graphics on this Website are used separately from accompanying text; and
(c) any of our copyright and trade mark notices and this permission notice appear in all copies.

6.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with clause 5.1 above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website.

6.3 Subject to clause 5.1, no part of this Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.

6.4 Any rights not expressly granted in these terms are reserved.

7. SERVICE ACCESS

7.1 While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.

7.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

8. WARRANTY

Conditions of warranty on goods are governed by Sellers Warranty Claim Policy and by legal regulations in force in the Czech Republic.

9. FINAL PROVISIONS

These General Terms and Conditions are effective as of 12.5.2020 and supersede all previous provisions and practices. The Hobbyshop reserves the right to change these General Terms and Conditions without previous notice.
